TERMS OF SERVICE

These Terms of Service ("Terms") govern the use of hosting, server, and related services provided by VNETWORK GROUP PTE. LTD. ("VNETWORK"), Unique Entity Number (UEN) 202231335D, with its registered office at 111 North Bridge Road, #17-06 Peninsula Plaza, Singapore (179098). By registering for or using the services, the Customer ("you" or the “User”) agrees to be bound by these Terms.
Clause 1. No Warranty as to Information on the Server
VNETWORK is not responsible for, and does not guarantee, the accuracy of any information sent to the server by any person. VNETWORK accepts no legal liability for, and shall not be required to remedy or compensate for, any loss of or damage to data stored on the server.
Clause 2. Responsibility for Data
The User is responsible for maintaining and preserving their own data on the server.
Clause 3. Lawful Use
The User is solely responsible for using their Website or Server for lawful purposes only, and warrants the same to VNETWORK. In particular, the following restrictions apply:
- 3.1. The User may not submit, or create links or feeds to:
- a. Any data that is illegal, threatening, deceptive, hateful, misleading, defamatory, obscene, pornographic, or offensive; that facilitates information theft; or that is otherwise prohibited in any manner.
- b. Any data that constitutes or encourages any form of crime, or that infringes any patent, trademark, design, copyright, other intellectual property right, or any other right of any person.
- 3.2. The User may not send disruptive bulk email from VNETWORK’s server or network, and is discouraged from operating any site hosted on the server that relies on bulk email.
- 3.3. The User may not run programs that clog or slow down the system, such as those that exhaust system resources or overload the processor and memory.
Clause 4. Account Security
The User shall keep their identifying information, passwords, and other confidential information relating to their account secure, and shall notify VNETWORK immediately upon detecting any unauthorized access to their account or any security vulnerability, including any loss, theft, or disclosure of passwords or other confidential information.
Clause 5. Compliance with Procedures
The User shall comply with the procedures established by VNETWORK and shall not use the hosting and servers in any manner that may adversely affect VNETWORK’s other customers.
Clause 6. Access to Linked Networks
Any access to other networks linked to VNETWORK’s network is subject to the respective rules and laws governing those networks.
Clause 7. Limitation of Liability for Data Loss
While VNETWORK takes all reasonable measures to ensure the integrity and safety of data on the server, VNETWORK makes no guarantee in the event that the server is compromised by unauthorized users or hackers, or in the event of hardware failure attributable to the manufacturer, and is not responsible for any resulting data loss.
Clause 8. Suspension and Termination
If the User fails to pay applicable fees, or breaches any of the provisions above, VNETWORK may suspend the services and/or immediately terminate the contract without prior notice.
Clause 9. No Refund for User Breach
VNETWORK will not refund any amounts for a service interruption caused by the User’s breach of the provisions above, unless VNETWORK elects not to continue providing the service.
Clause 10. Right to Terminate for Unlawful Use
VNETWORK has the right to cease providing the service, without responsibility for the data and without any obligation to refund any costs to the Customer. The Customer shall also bear full responsibility before the law in the following cases:
- Using virtual machine (VM) resources for VPN purposes in order to prevent attacks from affecting the system.
- Taking advantage of the provision and use of Internet services and online information to oppose the State of the Socialist Republic of Vietnam; to harm national security or social order and safety; to undermine national unity; to conduct propaganda for war or terrorism; to incite hatred or conflict among ethnic groups or religions; to promote or incite violence, obscenity, depravity, crime, social evils, or superstition, or to sabotage the nation’s fine customs and traditions; to disclose state, military, security, economic, foreign-affairs, or other secrets prescribed by law; to disseminate information that distorts, slanders, or offends the reputation of an organization or the honor and dignity of an individual; to advertise, promote, or trade in prohibited goods and services, or to distribute prohibited journalistic, literary, or artistic works and publications; or to impersonate organizations or individuals and spread false information.
- Creating unauthorized links to the legitimate domain names of organizations or individuals; creating, installing, or distributing malware and computer viruses; illegally infiltrating or seizing control of information systems; or creating tools for attacks over the Internet.
- The Customer is responsible under the law for any information they store, transmit, provide, or distribute over the network. Private information of organizations and individuals shall be kept confidential in accordance with the law, and the control of private information over the network shall be carried out by the competent state management agencies in accordance with the law.
- The Customer may set up aggregate websites and social networks only if they hold a license to establish an aggregate website or a license to establish a social network.
- The Customer shall comply with the laws on Internet use, the terms of service specified in the Contract, and Decree No. 72/2013/ND-CP on the management, provision, and use of Internet services and online information.
Clause 11. Domain Name Disputes
All disputes relating to .VN domain names shall be handled in accordance with the regulations of the Vietnam Internet Network Information Center (VNNIC). All disputes relating to international domain names shall be handled in accordance with the regulations of the organization managing the relevant top-level domain (ICANN).
